These terms apply when you use fezziwigsmarket.com or buy from Fezziwig's Marketplace, 225 W. 1st Street, O'Fallon, Illinois. By placing an order you agree to them. Please read the sections on classes and on food and allergens in particular, since those are the ones that catch people out.
Ordering
You must be at least 18 to place an order. Placing an order is an offer to buy, not a completed sale. We confirm the sale when we send your order confirmation. If an item turns out to be unavailable, or a price or description was wrong, we may cancel the order and refund you in full. We will always tell you why.
Prices and availability
Prices are in US dollars and do not include sales tax or shipping, which are added at checkout. We are a small shop with hand-counted inventory, so occasionally something sells out between your order and our packing table. If that happens we will contact you with the choice of a substitute, a partial refund, or a full refund.
Food, ingredients, and allergens
We sell food. Always read the physical package before you eat or serve anything. The packaging is the authoritative source for ingredients, allergens, and preparation instructions. Ingredient information on this website is provided for convenience and may not reflect a supplier's most recent change.
Many of our products are packed in facilities that also handle milk, eggs, wheat, soy, peanuts, tree nuts, sesame, and fish. If you have a food allergy, call us at (618) 726-2230 before ordering and we will check the packaging in hand for you.
Our products are foods, not medicine. Nothing we sell or say is intended to diagnose, treat, cure, or prevent any disease. Talk to your doctor about anything health related, particularly if you are pregnant, nursing, or taking medication.
Classes, tastings, and events
- All sales are final. We do not offer refunds, exchanges, or credits, including for no-shows.
- You may send someone in your place. Tell us the name in advance so we are expecting them.
- If we cancel, you choose between a full refund and a credit toward another class.
- Seats are limited and sold first come, first served.
- Some events include alcohol. Guests being served alcohol must be 21 or older and may be asked for identification.
- Tell us about dietary restrictions when you book. We will do what we reasonably can, but we cannot guarantee an allergen-free environment in a working kitchen.
- Classes take place at the shop. Please arrive a few minutes early.
Gift cards and gift certificates
Our gift cards and gift certificates do not expire and carry no fees, as Illinois law requires. They are redeemable for merchandise and classes. They cannot be redeemed for cash except where the law requires it, and they cannot be replaced if lost or stolen, so treat them like cash.
Shipping, delivery, and returns
See our Shipping and Returns page, which forms part of these terms. Title and risk of loss pass to you when the carrier takes possession of your order. If a package is lost or damaged in transit, tell us and we will work with the carrier on your behalf.
Reviews and anything else you post
If you submit a review, photograph, or comment, you keep ownership of it and you give us permission to display and share it in connection with our shop. Please only post things that are true and your own. We may remove content that is unlawful, abusive, or has nothing to do with the product. We do not edit reviews to make them more favorable and we do not remove a review for being critical.
Our content
The text, photographs, recipes, and design on this site belong to Fezziwig's Marketplace or to the brands we carry. You are welcome to share a link, print a recipe for your own kitchen, or quote us with credit. Please do not copy our product descriptions or photographs for a commercial purpose without asking. Brand names and logos belong to their owners.
Recipes
Our recipes are offered in good faith for home cooks. Cooking involves knives, heat, and sometimes alcohol. Use your judgment, follow safe food handling practice, and adapt for any allergy or dietary need in your household.
Accuracy of this site
We work to keep prices, descriptions, stock, and class dates correct, and we sometimes get something wrong. We reserve the right to correct errors and to update this site at any time.
Disclaimers and limits
Except where the law does not permit it, our website and its content are provided as they are, without warranties of any kind. Nothing here limits any warranty that applies to a product under the law, or any right you have as a consumer that cannot be waived. To the extent the law allows, our liability for any order is limited to the amount you paid for it.
Governing law
These terms are governed by the laws of the State of Illinois. Any dispute will be handled by the state or federal courts serving St. Clair County, Illinois.
Changes
We may update these terms. The version in force is the one posted here on the day you place your order, and the date at the top tells you when it last changed.
